These Terms of Service (“Terms”) set out the terms on which Interconnect Networks Pty Ltd (ACN 659 014 767, ABN 35 659 014 767), trading as WebShield (“WebShield”, “we”, “us”, “our”), supplies internet, content filtering, VoIP phone, web hosting and related services (“Services”) to you. By ordering, activating or using a Service, you agree to these Terms.

These Terms should be read together with the Critical Information Summary (CIS) and pricing schedule for your plan, our Acceptable Use Policy, our Privacy Policy and our Complaints Handling Policy, each of which forms part of your agreement with us.

1. Our Services

We supply the Services described on our website and in the CIS for the plan you select. Service availability, speeds and features depend on factors including the access network, your location, your equipment and the plan you choose. Some plans and offers are not available in all regions and do not apply to all service types.

Our content filtering is designed to reduce access to certain categories of online content. No filtering service can block all unwanted content in every case, and filtering should not be relied on as the only method of supervision. We do not represent that filtering is complete or that it cannot be circumvented.

2. Eligibility and your account

To acquire a Service you must be at least 18 years of age and provide accurate account and identity information. You are responsible for keeping your account details and passwords secure, and for activity that occurs under your account. Please tell us promptly if you believe your account has been accessed without your authorisation.

We may carry out identity verification and, where appropriate, a credit assessment before providing a Service. We may accept or decline an application at our discretion.

3. Acceptable use

Your use of the Services must comply with our Acceptable Use Policy and with all applicable laws. The Acceptable Use Policy forms part of these Terms. A serious or repeated breach of that policy may lead to suspension or termination of your Service under clause 6.

4. Billing and payment

  • You agree to pay the charges for your Service as set out in the CIS and pricing schedule for your plan, including any plan fees, usage charges, add-ons, equipment charges and non-standard installation charges.
  • We bill in advance for recurring plan fees unless your plan states otherwise. Charges are billed to the billing address and payment method on your account.
  • You must keep a valid payment method on your account for the duration of your plan. Where you have authorised direct debit or card payment, you authorise us to deduct charges as they fall due.
  • If a payment is not made by its due date, we may charge reasonable costs permitted by law and may restrict, suspend or disconnect your Service in accordance with clause 6.
  • If you believe a charge is incorrect, contact us and we will investigate it under our Complaints Handling Policy.

5. Promotional offers

Where you take up a promotional offer, the specific terms and conditions of that offer apply in addition to these Terms. Promotional discounts are generally available to new residential customers only, may be used once per customer and premises, are non-transferable, cannot be combined with other offers, and cannot be redeemed for cash. If you change your plan during a discount period, the discount may be removed and pricing may revert to the standard charge set out in the CIS. After a promotional period ends, standard pricing applies. We may vary or withdraw offers, products and services at any time, subject to law and to any offer terms you have already accepted.

6. Suspension, restriction and termination

We may restrict, suspend or terminate your Service:

  • where you materially breach these Terms or the Acceptable Use Policy;
  • where payment is overdue and remains unpaid after we have given you notice;
  • where required to protect the security or integrity of our network or other users;
  • where we are required to do so by law or by a supplier or carrier; or
  • where we reasonably suspect fraud or unlawful use of the Service.

Where practicable and appropriate, we will give you notice and an opportunity to fix the issue before we suspend or terminate. You may cancel your Service by contacting us; cancellation terms, any notice period and any applicable charges are set out in your plan’s CIS.

If you are experiencing difficulty paying, please contact us — we have a Financial Hardship Policy and will work with you to find a suitable arrangement before disconnection where possible.

7. Your equipment and installation

You are responsible for providing and maintaining any equipment needed to use the Service that we do not supply, and for ensuring it is compatible and in good working order. Standard installation is included where stated; non-standard installation and additional work may attract further charges, which we will discuss with you.

8. Consumer guarantees and liability

Nothing in these Terms excludes, restricts or modifies any right or remedy, guarantee, warranty or other term or condition implied or imposed by the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) or any other law that cannot lawfully be excluded or limited. You may be entitled to a remedy under the Australian Consumer Law if a Service is not provided with due care and skill or is not fit for a specified purpose.

To the extent permitted by law, and other than for liability that cannot be excluded, our liability to you for a failure to comply with a consumer guarantee is limited, at our option, to resupplying the relevant Service or paying the cost of having it resupplied. To the extent permitted by law, we are not liable for indirect or consequential loss, and we are not responsible for third party products or services, or for matters outside our reasonable control.

9. Changes to these Terms

We may change these Terms, our plans, pricing and policies from time to time. Where a change is more than minor and adversely affects you, we will give you notice as required by law and, where applicable, an opportunity to respond. The current version of these Terms will always be available on our website.

10. Notices

We may give you notices by email to the address on your account, by post to your billing address, through your online account, or by other means permitted by law. You can give us notices using the contact details below.

11. Dispute resolution

If you have a concern or complaint, please contact us first — we will handle it under our Complaints Handling Policy. If your complaint is not resolved to your satisfaction, you may refer it to the Telecommunications Industry Ombudsman (TIO) at tio.com.au or on 1800 062 058. The TIO service is free.

12. Governing law

These Terms are governed by the laws of South Australia, and you and we submit to the non-exclusive jurisdiction of the courts of South Australia and the Commonwealth of Australia.
